CONTRACT OF HIRE
The hiring contract shall be between the Client/Hirer/Guest
and the Owners of the property. They shall be deemed to be
made subject to these conditions of hire. The contract of hire
is not effective until the Client receives a written
confirmation of booking. Our home is a registered non-smoking
property, therefore, SMOKING IS PROHIBITED INSIDE THIS HOUSE.
INITIAL PAYMENT
Bookings will be confirmed upon receipt of the required
deposit payment and the signed booking form. However, if the
booking is made within 2 months of the holiday commencement
date, the full amount of rental will be required on booking.
BALANCE PAYMENT,
CONFIRMATION OF BOOKING BAND REFUNDABLE SECURITY DEPOSIT
The balance of hire will be due 2 months before the holiday
commencement date. The Owners reserve the right to cancel a
booking where full payment has not been received 8 weeks prior
to the holiday commencement date. Bookings made within 8 weeks
of departure require full prepayment. A security deposit from
£250 ($375) is required with the final balance payment
dependent upon party size. This is fully refundable upon
return of the house keys and garage door opener and
confirmation by the Owners' agent that the house is in good
order.
Once confirmation has been issued, the Hirer is responsible
for the total price of the property rental as shown on the
confirmation. Signing the booking form constitutes acceptance
of these terms & conditions by the Hirer.
CANCELLATION
Provided the Owners receive written notice of cancellation not
less than 10 weeks before the commencement date the Hirers
will not be required to pay the full balance, however, the
amount of the deposit will be forfeited. All cancellations
must be notified in writing at the earliest opportunity. In
the event of the Hirer having to cancel the booking, the
following charges will apply:
More than 10 weeks prior to the date of the holiday - Deposit
only
Between 8 - 10 weeks prior to the date of the holiday - 50% of
the rental
Less than 8 weeks prior to the date of the holiday - 100% of
the rental
LIABILITY
The property Owners cannot accept any liability whatsoever for
any injury sustained by guests or any other visitors to the
home or swimming pool or any loss or damage howsoever caused
to any property brought on to the premises or for distress,
financial claim or claim of any sort howsoever incurred. All
information concerning the property is checked to ensure the
accuracy of descriptions. However, the Owners are not always
able to control all of the components of the facility and it
is possible that an advertised facility may be withdrawn or
changed due to circumstances beyond their control and for
which they cannot accept responsibility. It is expressly
agreed upon that the Hirer will hold harmless the Owners,
their representatives or agents, for any accident, injury or
distress, financial claim or claims of any sort, that may
result from any such accident, injury or distress by the Hirer
or any other person howsoever caused or incurred.
PARTY SIZE
Under no circumstances may more than the agreed maximum number
of persons booking occupy the property. THE OWNERS RESERVE THE
RIGHT TO REFUSE ADMITTANCE IF THIS CONDITION IS NOT OBSERVED.
CLIENTS
RESPONSIBILITIES AND DAMAGES
The Client is responsible for the property and is expected to
take all responsible care of it. All household equipment,
utensils, etc., furniture and carpets must be left clean and
tidy at the end of the hire period. All damages and breakages
are the responsibility of the Hirer and such costs shall be
payable on demand and may be deducted from the security
deposit, including extra cleaning if required after the
Hirer's departure or the excessive use of electricity or
improper use of the air conditioning system.
ARRIVALS AND
DEPARTURES
The property will be available from 5 pm on the day of arrival
and must be vacated by 11 am on the day of departure unless
otherwise stated by or agreed with the Owners. These times
must be strictly enforced to facilitate cleaning and a smooth
changeover.
CHANGES OR
CANCELLATION BY OWNERS
Wherever possible, all changes will be advised to the Hirer,
without delay. Should circumstances beyond the Owners control
require them to cancel a booking, they will where possible
make alternative arrangements. Should this prove unacceptable
and once instructions have been received in writing from the
Hirer, the Hirer will receive a refund of all monies paid but
excluding any monies expended on the Hirers behalf.
INSURANCE
The Hirer is strongly advised to take out fully comprehensive
travel insurance cover. Hirer to also ensure adequate cover
obtained for cancellation due to unforeseen circumstances.
NEVER TRAVEL WITHOUT INSURANCE. The Owners are not responsible
for any deaths, injuries, illness or loss of or damage to
property including motor vehicles or to that of any guest
howsoever caused. Guests are specifically required to
supervise children at all times in the pool area. In order to
comply with USA immigration, Clients to ensure that they and
all their party have at least six months validity on their
passports for their holiday.
CONDITIONS OF CARRIAGE
These booking conditions are subject to the conditions of
carriage of the Hirers road rail airline or sea carrier when
they travel with them to or from the Hirers holiday
destination and these contain certain conditions which limit
or exclude liability.
WEBSITE / BROCHURE
The website/brochure/information sheets are a guide to the
quality and description of the property but layout may vary.
The Owners reserve the right to make modifications, which are
shown to be necessary in the light of operating experiences.
In the event that unintentional errors mistakes omissions
occur, the Owners cannot accept responsibility for these
details.
FORCE MAJEURE
The Owners accept no responsibility for and shall not be
liable in respect of loss or damage or changes caused by force
majeure events (e.g. strikes, fire, flood, closure of airport,
weather conditions, pestological events) or any other event
beyond their control. |
